Celtic TV Terms & Conditions

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

These are the terms and conditions (the "Terms and Conditions") for subscribing to The Celtic TV subscription service (the "Service"). This Service is provided to you, the subscriber ("you", "your") on the basis that you accept these Terms and Conditions. It is a legal agreement and it sets out the rights and obligations of you and Celtic F.C. Limited. By purchasing the Service you are agreeing to be bound by these Terms and Conditions. By continuing to use the Service you accept any revised version of these Terms and Conditions that we notify you of.

Who we are. We are Celtic F.C. Limited, a company registered in Scotland. Our company registration number is SC223604 and our registered office is at Celtic Park, Glasgow, G40 3RE. Our registered VAT number is 653 0293 52 ("we", "us", "our"). Celtic TV and all its variations are owned and operated by Celtic F.C. Limited.

How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you registered with. When we use the words "writing" or "written" in these terms, this includes emails.

Our contract with you

Your order will be final when you select the ‘Subscribe or Pay’ option in the Celtic TV online purchase process.

How we will accept your order. Our payment agent will notify you by email that we have debited your credit / debit card and that you have been granted access to the Service. The email message will constitute our acceptance of your request to access the Service. At this point a contract will come into force between us and you for provision of the Service. Our acceptance of your order will be deemed complete and received by you at the time and date our payment agent sends the email, which time and date is specified on the email. You must keep this email in the event you wish to cancel the Service.

To the extent that these Terms and Conditions conflict with the Website’s Terms of Use, the order of priority shall be: (i) these Terms and Conditions; and (ii) the Terms of Use.

The Service

In accessing the Service, we provide you with access to the advertised features and services described on www.celticfc.tv (the “Website”). We set out below, and on the Website, the technical requirements you need to have in place to access the Service. Before placing your order, we recommend that you view the preview content available on the Website to ensure that you can access content satisfactorily.

Due to broadcasting restrictions, your access to the Service is dependent on your geographical location. You confirm that the country of residence that you give at the time of registration is the country you will access the Service from. Your access to the Service may be suspended without refund if you attempt to access from any location other than your country of residence. If you wish to access the Service while travelling contact our support team on webhelp@celticfc.com.

If you change your email address, it is important that you update your profile with your new address to ensure that you can continue to access the Service. We will not be liable for your inability to access the Service where you have not provided correct and up to date information to enable us to deliver the Service.

UK & Republic of Ireland (“ROI”) Customers

If you access the Service from the UK (including Northern Ireland, the Channel Islands and Isle of Man) or ROI, you may purchase an annual “UK Online” subscription or “Premium UK” subscription.

The UK Online and UK Premium Subscriptions entitle you to:

* Live audio commentary for all Celtic domestic cup, SPFL and UEFA matches;

* Replays of Celtic’s SPFL and UEFA matches following a holdback period. These matches will not be live and will be delayed for a period depending on broadcasting restrictions applicable to the content in question (the “holdback period”);

* Replays of certain Celtic domestic cup matches following a holdback period, where that is possible (subject to the availability of rights and coverage of such matches); and

* on-demand footage from the Celtic TV video archive.

In addition, the Premium UK subscription further entitles you to the highest bandwidth streams available on Celtic TV – Note that to receive this you will require at least 3 Mbps download speed.

Customers outside UK & Republic of Ireland (ROI)

If you access the Service from outside the UK (including Northern Ireland, the Channel Islands and Isle of Man) or ROI, you may purchase an annual or monthly “Online Plus” or “Premium” subscription.

The Online Plus and Premium subscriptions entitle you to:

* all live Celtic SPFL matches;

* live audio commentary for all Celtic UEFA matches;

* full match replay for all Celtic UEFA matches from 11pm (UK time);

* live access to Celtic domestic cup matches where possible (subject to the availability of rights or coverage of such matches); and

* on-demand footage from the Celtic TV video archive.

In addition, the Premium UK subscription further entitles you to the highest bandwidth streams available on Celtic TV – Note that to receive this you will require at least 3 Mbps download speed

Access to Celtic TV

When you receive the email confirming that your payment has been accepted, you will be able to access the Service using the correct username and password with which you subscribed to the Service. Only one device can access the Service at any one time with your username and password.

Your right to access the Service is personal to you. You are wholly responsible for your access to the Service by any person using your terminal or point of presence and you are responsible for ensuring that any such person also fully complies with these Terms and Conditions. You agree to access the Service in a manner consistent with any and all applicable laws and regulations in the country from which you have accessed this Service. You must not (nor authorise or permit any other party to): (a) abuse your access to the Service or use it for any unlawful purpose; (b) access the Service in a way that may cause the set, software, applications or other equipment used by us to provide this Service (the "System") to be interrupted, damaged, rendered less efficient or impaired; (c) store your password anywhere on a computer in plain text; (d) access or record the Service in any manner which violates or infringes the rights of any person, firm or company (including without limitation rights of intellectual property, confidentiality or privacy) or breaches these Terms and Conditions; (e) reproduce, modify, distribute or publish the whole or any part of the content of the Service without our prior written permission; or (f) sell, assign, transfer or delegate to another person or entity all or any of your rights and obligations in the Service or any part of it.

Celtic TV Gift Voucher

If you are purchasing Celtic TV as a gift, both you and the person receiving the gift will be bound by these Terms and Conditions. If a gift voucher is cancelled and a refund is requested, the refund will be allocated to the same card used to make payment for the gift voucher.

Technical Requirements

In order to use the Service, you must (a) obtain access to the internet and pay any service fees associated with such access; (b) provide all equipment necessary to make such connection to the internet, including a computer or mobile device and broadband connection. For the Premium high bandwidth service a continuous broadband connection of 5Mbps is required.

We recommend that to watch live video footage on the Online+ service or as-live video on the Online service that at least 2 Mbps broadband connection or greater is used (for audio footage a modem connection is more than acceptable) or other necessary access device. You must have a suitable browser for your operating system - see the FAQs on the Website for the currently recommended software (the "Software") installed on your computer or device.

Your use of the Software is subject to the terms of the licence granted to you by the relevant licensor. We are not providing and are not responsible for the Software, or for any problems caused by the Software, computer hardware or computer operations systems.

We will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum technical requirements advised by us.

Payment

You must pay the subscription fee (the "Fee") applicable to the specified Service which you have subscribed for, in accordance with the fee plan notified to you at the time of registration. The Fee will be automatically billed against the credit / debit card number that you provide in the registration form.

Payment may be made by any of the following credit, debit or prepaid cards: Visa, Mastercard or Maestro or other cards accepted by our payment agent. Unless otherwise stated, charges are inclusive of any applicable VAT and any other taxes applicable from time to time, for which payment you shall be liable. Payment for the Service is charged on a recurring monthly in advance or annual in advance subscription basis until cancelled by you.

We reserve the right to vary the Fee for each subscription package from time to time. Any increases in the Fee will be notified to you by email and published on the Website at least 30 days prior to such price increases taking effect. If you do not cancel your subscription contract prior to the price increase becoming effective we shall continue to collect the increased payments from you commencing with the next payment due under the subscription package.

Payment for Celtic TV outside the UK and ROI

For Online Plus or Premium subscriptions, accessible only outside the UK and ROI, payment must be received via a credit / debit card registered in the country of residence.

Renewal

Your subscription will renew automatically at the end of the monthly or annual period of your subscription (as applicable). We will notify you in advance of your renewal date and we will collect payment automatically on the date your subscription is due to renew, with the card details used to make your original payment. If you wish to cancel your subscription, you may do so at any time before your renewal payment is due to be collected. To cancel, you must access the payment agent website using the details supplied to you by email by the payment agent on completion of the contract and follow instructions for cancellation. When you cancel your monthly or annual subscription you will receive the benefit of the Service you have already paid for in advance, and your right to access the Service will continue until the date on which the next instalment of your payment would have become due.

Your Conduct

You must comply with the Website Terms of Use at all times when accessing the Service and the Acceptable Use Policy set out below when posting any content through the interactive section of Celtic TV. Your failure to do so may result in suspension of the Service, and disclosure of your details to any court or competent authority for the purpose of enabling them to take further legal action against you.

Suspension and Termination

We may suspend or terminate the Service or your access to the Service at any time in our absolute discretion if: (a) your access to the Service is considered to be in breach of these Terms and Conditions or our website’s Terms of Use; (b) the Fee or any instalment of the Fee remain outstanding; and/or (c) a court or competent regulatory authority requires our provision of the Service to be terminated.

We may, at our own discretion, terminate your annual subscription upon giving you one month's notice by email. Should we terminate your annual subscription pursuant to the foregoing we shall pay to you a pro rata refund of your Fee.

Maintenance

From time to time, your access to the Service may be suspended in order for work to be carried out relating to the upgrading or maintenance of the System or otherwise as necessary for the provision of the Service. We shall give as much notice as is reasonable in the circumstances and shall endeavour to ensure that such works are carried out as expeditiously as is possible in the circumstances and not during match time unless unavoidable.

Licence and Intellectual Property

As part of the Service we may provide access to certain video and audio footage, photographs, text images, statistics, logos and other media and intellectual property related to Celtic Football Club. All design, text, graphics, footage and the selection or arrangement thereof are the copyright of us or our respective licensees or licensors.

Access to the Service is granted FOR PERSONAL USE ONLY, and you are not entitled to download, copy decompile, reverse engineer, re-distribute or otherwise alter any material viewed via the Service, including, but not limited to, any files, codes, audio, or visual images incorporated in or generated by the software. You acknowledge and agree not to sublicense, assign, or otherwise transfer this license. The Service is not for viewing in commercial or other premises where more than one individual can view the Service unless otherwise agreed with us in writing. The use of proxy servers, virtual private networks or other similar technologies to circumvent this provision or otherwise is strictly prohibited without our prior, written consent.

Breach of this provision is a material breach of these terms and conditions and will lead to immediate termination by us.

Tax Outside UK and ROI

You may be subject to taxes on your registration, which are levied in respect of the Service. These duties and taxes plus any additional administrative charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs and taxation policies vary widely from country to country; you should contact your local customs or tax office for further information.

Your personal data

We are a data controller in respect of personal data submitted by you and will hold and process personal data for legal and administrative purposes (including sending you important service messages and sharing benefits related to your subscription) and, where we are permitted to, for marketing purposes. We may also analyse the information provided and/or data about your use of the service to help improve the Service, personalise content and administer our contract with you. The personal data provided to us shall be processed, stored and transferred in accordance with all applicable data privacy laws and the terms of our privacy policy, which is available on the Website.

General

Any notices we send will be sent to the email address you supply during the registration process. Any notices you send us should be sent by email to: webhelp@celticfc.com. Notices will be deemed to have been delivered at the time and date of sending of the email, which time and date are specified in the email.

If we fail to exercise or enforce any right we have under these Terms and Conditions such failure will not be deemed to be a waiver of that right nor will it prevent us exercising or enforcing that right on a later occasion.

We are not liable for business losses. We only supply the Service for domestic and private use. If you use the Service for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We may transfer our rights and obligations under these Terms and Conditions to a group company or other third party. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

The contract shall be governed by Scots law and subject to the non-exclusive jurisdiction of the Scottish courts. Please note that disputes may also be submitted for online resolution to the European Commission Online Dispute Resolution platform.

Celtic TV Acceptable Use Policy

These content standards apply to any and all material, content or comments which you contribute anywhere on the Website or via the Service (“contributions”), and to any interactive services associated with it.

You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

* Be accurate (where they state facts);

* Be genuinely held (where they state opinions); and

* Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

* Contain any material which is defamatory of any person;

* Contain any material which is obscene, offensive, hateful or inflammatory;

* Promote sexually explicit material;

* Promote violence;

* Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

* Infringe any copyright, database right or trade mark of any other person;

* Be likely to deceive any person;

* Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

* Promote any illegal activity;

* Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;

* Be likely to harass, upset, embarrass, alarm or annoy any other person;

* Be used to impersonate any person, or to misrepresent your identity or affiliation with any person;

* Give the impression that they emanate from us, if this is not the case; or

* Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

We will determine, in our absolute discretion, whether there has been a breach of this acceptable use policy through your use of the Service. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the Terms and Conditions, and may result in our taking all or any of the following actions:

* Immediate, temporary or permanent withdrawal of your right to use the Service;

* Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.

* Issue of a warning to you;

* Legal proceedings against you for reimbursement of all costs, liabilities, expenses and losses on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

* Further legal action against you; and/or

* Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Pay-per-view Definitions

In these Terms and Conditions, the following words and phrases shall have the following meanings:

Digital Media means the Celtic TV website only;

Company means The Scottish Professional League Limited.

Live means as contemporaneously to the event taking place as technology allows;

PPV Terms and Conditions means these terms and conditions;

Pay-Per-View Ticket means the right to view the Relevant Match on a Live basis via the Digital Media in the Territory accordance with these Terms and Conditions;

PPV User means a natural person who has been supplied with a Pay-Per-View Ticket for a Relevant Match during Season 2023/24 and who uses same to access Live broadcast coverage of one or more Relevant Matches during that Season through the Digital Media;

Relevant Match means any of a Club’s Home League Matches, Home League Cup Matches, Home Scottish Cup Matches or Home or Away European matches in respect of which a Club is permitted to and has made Pay-Per-View Tickets available and in respect of which you have bought a Pay-Per-View Ticket.  Always subject that a Pay-Per-View Ticket is not available and must not be sold or otherwise distributed for a Club’s League Match where such Official Match is being broadcast live by Sky UK Limited under and in terms of its Commercial Contract with the Company;

Restricted Period means the period during the 2024/25 Season;

Territory means the United Kingdom and the Republic of Ireland, unless a match has been given worldwide broadcast rights then Territory shall mean The World.

In these Terms and Conditions, capitalised words and phrases not herein defined but used herein, have the meanings given to them in the Rules, as from time to time amended, of The Scottish Professional Football League (https://spfl.co.uk/pages/rules-and-regulations).

2. Contract, Registration and Username/Password

2.1 Pay-Per-View Tickets are issued subject to these Terms and Conditions and are also subject to the applicable terms and conditions for use of/access to the relevant Digital Media applicable privacy policy, which (as updated over time) are incorporated into these Terms and Conditions and form part of the contract.

2.2 To obtain a Pay-Per-View Ticket you must do so via the Digital Media. On registration you will be required to enter a username and password. You must keep the password secure and not disclose it to any other Person.

2.3 Your right to use your Pay-Per-View Ticket is personal to you and is limited to viewing on one device at any time. If your password becomes known by a third party, you must immediately change your password. We are not liable for any loss or damage arising from your failure to comply with this obligation and/or for any loss and/or misuse of or failure by you or on your behalf to protect and preserve as confidential your password.

You confirm that:

you are at least 16 years old and at least 18 years old if paying by Credit Card;

(b) you are solely resident in the Territory. Please note you must notify us immediately if you cease to be resident in the Territory, in which case you will cease to be entitled to use the Pay-Per-View Ticket;

(c) you will only use your Pay-Per-View Ticket to view audio visual material broadcast via Digital Media and will at all times comply with these Terms and Conditions; and

(d) the information which you provide is true, accurate and complete in all respects at that time. You must also notify us immediately of any changes to your information by either updating the details on the TV site or emailing support@streamdigital.tv

3. Use of the Pay-Per-View Ticket

3.1 Details of how holders of Pay-Per-View Tickets will be able to view the Relevant Match on a Live basis will be set out on the Website. You will need to log in using your username and password.

3.2 Every Pay-Per-View Ticket may be individually terminated in accordance with these Term and Conditions.

3.3 Pay-Per-View Ticket content includes video and audio footage, statistics, logos and other media and intellectual property related to the Club, the Relevant Match, the Scottish Professional Football League, the Scottish Football Association and UEFA (as applicable) and their respective commercial partners. All such footage and other materials and their selection or arrangement are comprised the intellectual property rights (including, amongst other things copyright) of the Scottish Professional Football League Limited, the Scottish Football Association and UEFA (as applicable) In particular, all audio-visual coverage of League Matches and all on screen graphics during such Matches, including all copyright therein, is the sole and exclusive property of The Scottish Professional Football League Limited. You will not own any of the content.

3.4 A Pay-Per-View Ticket is a content access service only. The Digital Media is not responsible for any problems caused by your computer hardware, computer operating systems, internet connection or other software installed on your computer or other device.

3.5 In order to access and use the Pay-Per-View Ticket service, you will need to provide all necessary equipment including a computer and access to the internet, with you being responsible for any service fees associated with such access via Wi-Fi or mobile data. You will require a Wi-Fi or broadband internet connection (DSL/cable or higher) with a minimum download speed of at least 1.2mbps with latency not exceeding 100ms for SD video and 4mbps with latency not exceeding 50ms for HD video. Quality and accessibility of Live video streaming via mobile networks cannot be guaranteed.

3.6 For use of the Pay-Per-View Ticket service your device needs to comply with the following minimum system requirements (this may be updated occasionally, for which see section changes and updates section):

3.6.1 Windows computer with a quad core processor and 4GB RAM. Any built-in intel graphics not older than 5 years and a Nvidia card from GeForce FX, GTX, Quadro FX etc.

3.6.2 Apple Mac computers from 2007 onwards.

4. Obligations on holders of Pay-Per-View Tickets

4.1 You must not (nor authorise or permit any other person to):

(a) use your Pay-Per-View Ticket contrary to these Terms and Conditions, including use for any unlawful purpose contrary to any applicable laws and regulations;

(b) use your Pay-Per-View Ticket other than for private and domestic purposes. Under no circumstances must your Pay-Per-View Ticket nor any match footage or other content be accessed, viewed, recorded or used for commercial, or business purposes and you must not access, view or use your Pay-Per-View Ticket in circumstances where members of the public can view the accessible match footage or other content (whether simultaneously or not);

(c) forward, record, copy, reproduce, store, transfer, modify, post, re-transmit, distribute or publish any match footage or otherwise forward any match footage to any other person. Without prejudice to the generality of the foregoing, match footage must not be transferred to or otherwise displayed on any electronic communications site or service (such as YouTube or live streaming sites) which can be accessed by third parties;

(d) sell, assign, transfer or delegate all or any of your rights and obligations in this contract to another person or organisation, or share use of your Pay-Per-View Ticket or any content contained or accessed within it;

(e) disclose your username and password to any other person and not store your username and password anywhere on a computer or mobile device in plain text;

(f) use your Pay-Per-View Ticket in any manner which violates or infringes the rights of any person, firm or company (including, amongst other things, rights of intellectual property, confidentiality or privacy);

(g) use your Pay-Per-View Ticket in a way that may cause the Digital Media and/or any equipment used by (our technology partners appointed to help provide the Pay-Per-View Ticket service) to be interrupted, damaged, rendered less efficient or impaired, nor try to gain unauthorised access to any of the systems through which Pay-Per-View Ticket is delivered;

(h) use a VPN (Virtual Private Network) service or similar to mask or otherwise hide or modify your actual location for the purposes of viewing the Relevant Home League Match outside the Territory; and

(i) distribute or publish any data or information in relation to the Relevant Home League Match

5. Changes & Updates

5.1 We may change the Digital Media via which the Pay-Per-View Ticket is utilised and/or these Terms and Conditions without giving you notice in order to:

(a) reflect changes in relevant laws or regulatory requirements;

(b) implement minor or emergency technical adjustments, for example to address a security threat;

(c) alter or improve the presentation of the user interface, or increase functionality;

(d) implement other minor changes which would not reasonably be likely to cause you a material detriment in your use of the Pay-Per-View Ticket or which we reasonably believe to be for the benefit of users.

5.2 We may update the underlying software relating to Pay-Per-View Tickets or require you to implement updates from time to time to use your Pay-Per-View Ticket. For example, as time goes on you may need to ensure your system remains compatible with technical requirements (see section 3).

5.3 If any change to these Terms and Conditions or changes carried out in accordance with them is found invalid, void or for any reason unenforceable, only that change will be disregarded, and it will not affect the validity and enforceability of any remaining changes or Terms.

6. Payment, Cancellation and Refunds

6.1 You must pay the applicable fees for the Pay-Per-View Ticket. The fee is inclusive of VAT.

6.2 Digital Media does not accept any responsibility for payments which are not received by us or accepted by your bank or payment card provider, other than where directly due to our fault.

6.3 By submitting your order, you have opted to receive your Pay-Per-View Ticket benefits immediately and you will not therefore be entitled to cancel the contract or have any fourteen (14) day ‘cooling off’ period in law, nor receive a refund of the fee. This does not affect any other rights you may have at law.

6.4 All live video or audio technical issues must be emailed to support@streamdigital.tv during the Relevant Match. Refunds will only be offered if you have proved to use our troubleshooting advice and support. If you do not take the time to troubleshoot or ignore emails and only request a refund without trying to fix the issue with our support team no refund will be issued.

7. Disclaimers and Liability

7.1 Neither Digital Media nor any of its staff or other representatives will be responsible or liable to you for any loss, damage, or inability to access and/or use the Pay-Per-View Ticket which:

(a) is due to any use you make of the Pay-Per-View Ticket, other than that we permit under this contract;

(b) is due to events outside our reasonable control. For example (and amongst other things) fire, floods, severe weather, terrorist activity, epidemic or pandemic, government regulation or civil disruption;

(c) is due to incompatibility of your devices or systems with the compatibility and technical requirements (see Section 3 above), including as may be later modified);

(d) is caused by viruses or other harmful data not caused by or attributable to an error or problem with Pay-Per-View Tickets or the relevant Digital Media;

(e) is caused by your failure to follow any reasonable, clear and easy to follow instructions we have made known to you relating to your use of your Pay-Per-View Ticket;

(f) concerns loss or damage:

(i) which is not a foreseeable result of our breach of these Terms and Conditions (though we will be responsible for loss or damage which is foreseeable). Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time we enter this contract, both you and we knew it might happen; or

(ii) relating to any business, including (amongst other things) loss of profits, loss of business, loss of opportunity and/or business interruption. Pay-Per-View Tickets are made available for private and domestic purposes only.

7.2 Digital Media does not limit or exclude our liability for death or personal injury resulting from our negligence; fraud; or for breach of your mandatory legal rights (for example, including our liability in UK consumer contract law if Pay-Per-View Ticket digital content is not of satisfactory quality, fit for purpose, in compliance with its description or we are found to not have rights to provide such content). You should seek your own legal advice in relation to any such rights at law.

8. Termination

8.1 Digital Media may terminate any Pay-Per-View Ticket (and the right for you to view any Relevant Match via the Digital Media), at any time, if:

(a) you do not make payment to us when it is due (or such payment has failed or been refused by your payment service provider);

(b) we are unable to verify or authenticate any information you have provided to us, including your location in the Territory when using any Pay-Per-View Ticket, where we reasonably need to do so (or information you have provided is incomplete or may be incorrect) and you do not, within a reasonable time of us asking for it, provide us with the required information that is necessary for us to make the Pay-Per-View Ticket available to you or where your location appears not to be aligned with any Pay-Per-View Ticket supplied to you and/or any Pay-Per-View Ticket supplied to you appears to be being used other than in the Territory;

(c) by reason of changes in the regulatory context in which the Relevant Match will be played we are no longer permitted to deliver live content in the territory by Pay-Per-View;

(d) we have reasonable grounds to believe you have and/or will committed/commit a material breach of this contract; and/or

(e) we have reasonable grounds to believe you are or have been using a VPN or device or arrangement having like or similar effect, when using any Pay-Per-View Ticket, and, in each case, no refund will be provided.

9. General

9.1 Any notices sent by Digital Media will be sent to the email address you supply during the registration process. Any notices you send to us must be sent by email to support@streamdigital.tv  Notices will be deemed to have been delivered, subject to being correctly addressed, at the time and date of sending of the email, which time and date are specified in the email.

9.2 If Digital Media fails or delays to exercise or enforce any right we have under this contract, such failure or delay will not be deemed to be a waiver of that right nor will it prevent us from exercising or enforcing that same or similar right on a later occasion.

9.3 This agreement is between Digital Media and you. No-one else will have any rights to enforce its terms. You may not assign or transfer your rights and obligations under this contract to anyone else nor may you provide to anyone else any username and/or password required to access and use any Pay-Per-View Ticket.

9.4 Digital Media may transfer our rights and obligations under this agreement to another organisation. We will endeavour let you know if this happens and will take reasonable steps to ensure that the transfer does not affect your rights under this contract.

9.5 This contract shall be governed by, and interpreted exclusively in accordance with, Scottish law. Each party irrevocably agrees that the Courts of Scotland shall have non-exclusive jurisdiction to hear and determine any suit, action or proceedings and to settle any disputes which may arise out of or in connection with this contract and for such purposes irrevocably submits to the jurisdiction of the Courts of Scotland.

10. Complaints

10.1 Technical support is provided by Stream Digital Limited. Should you require support or have a complaint about your Pay-Per View Ticket, please contact them in the first instance via e-mail at: webhelp@celtictv.com

10.2 Digital Media will endeavour to respond to any complaint within 7 working days of receipt of such communication. If it is not possible to provide a full response to the issue raised within that time, an acknowledgement will be sent, and we will use reasonable endeavours to send a detailed reply within 14 working days of receipt of the original communication.

10.3 Digital Media will attempt to resolve all justifiable complaints within 28 working days. If, however, this cannot be done, we will keep you updated on the progress of the complaint.

10.4 If you are having technical issues and are requesting a refund please ensure that you have notified us of a problem to support@streamdigital.tv with details of the problem, screenshots and information about the devices and browsers you are using.
